NerveOTX Try Before You Buy – Terms & Conditions
These Terms & Conditions (“Terms”) govern participation in the NerveOTX Try Before You Buy Program (“Trial Program”) for all NerveOTX devices, including but not limited to PRS, RX100, and DX500. By enrolling in the Trial Program and accepting delivery of a device, you agree to the following:
Eligibility
- You must be at least 18 years old to participate.
- You must reside in the United States.
- A valid credit or debit card must be provided at checkout.
- Prescription devices (such as the RX100) require a valid prescription from a licensed healthcare provider. Orders will not ship until a prescription is received and verified.
Trial Period
- Your trial period begins on the order date and runs for 90 days.
- The trial ends on the date shown in your order confirmation.
- To avoid being charged for the full device fee, you must:
- Email info@NerveOTX.com on or before the trial end date, and
- Physically drop off the device and all accessories with the approved shipping carrier (as instructed at cancellation) on or before the trial end date.
Automatic Conversion to Purchase / License
- If you do not complete the cancellation and return process by the trial end date, your participation automatically converts to a full purchase or license.
- The full device fee will be charged to your payment method on the trial end date without further notice.
- By enrolling in the program, you expressly authorize NerveOTX to process this charge if the return is not completed in time.
Fees
- Shipping and handling fees are non-refundable.
- Trial program fees are non-refundable.
- Full purchase or licensing fees apply if the return requirements are not met
Return Requirements
- All devices must be returned with:
- The original device,
- All cords, accessories, and components,
- In good working condition with no excessive damage.
- Missing or damaged items will result in repair or replacement charges up to the full device fee.
- Returns will not be accepted after the trial period has ended.
Warranty & Support
- All devices include a one-year limited warranty against manufacturing defects.
- The warranty begins on the “Try Before You Buy” order date.
- Wear-and-tear components (such as electrodes or lead cords) are not covered under warranty.
- Technical support is available during and after the trial at 833-277-9283 or info@NerveOTX.com.
User Responsibility
- You will be solely responsible for the equipment during the trial period, including any and all instances of theft, loss, damage, or disaster.
- You agree to use the device only as instructed in the official user manual.
- You acknowledge that results vary and are not guaranteed.
- You should stop use and consult a healthcare provider if you experience adverse reactions.
- Do not use direct current devices if you are pregnant, have an implanted electrical device, cancer, or a history of blood clots without medical clearance.
Limitation of Liability
- NerveOTX is not responsible for indirect, incidental, or consequential damages.
- Liability is limited to the total fees you have paid under this Trial Program.
Prompt Payment
- By clicking the submit button on the payment page and authorizing the charges on your card for today or at a future date, you are entering into a legal and binding contract with NerveOTX LLC to pay the total amount shown on the payment page, to be paid on each date as shown in the payment schedule.
- You acknowledge that the credit card(s), debit card(s) or other payment method(s) you are using to make this purchase will be active, valid and have sufficient funds available during the entire term of the payment schedule. You agree to maintain an active and valid credit card on file for automatic payment. All payments are due on the date specified in the payment schedule and will be charged automatically.
- If for any reason, any of your payments are declined, you agree to provide an alternative, valid payment method.
- Late or failed payments may result in a 1.5% monthly late fee (or the maximum allowed by law), referral to collections, and/or initiating legal action to recover all amounts due, together with reasonable attorneys’ fees, court costs, and collection expenses. You acknowledge that failure to meet payment obligations may negatively affect your credit and result in legal action.
