1. Sponsor

The Win a Free Direct Current Device (“Giveaway”) is sponsored by NerveOTX LLC (“Sponsor” or “NerveOTX”).

2. Contest Period

The Contest begins on 6.1.26 and ends on June 30th, 2026 at 11:59 p.m. Central Time (“Contest Period”).

Eligible submissions received during the Contest Period will be reviewed after the entry deadline, and the winner is expected to be announced on or before July 15th, 2026.

3. Eligibility

The Contest is open only to:

• legal residents of the United States;
• who are eighteen (18) years of age or older at the time of entry; and
• who comply with these Official Terms and Conditions.
• if selected, must be willing to create a 30-second video for why you want direct current in your life.
• if you win, must be willing to post your video and tag NerveOTX. 

The Contest is not open to employees, contractors, officers, directors, agents, representatives, judges, affiliates, subsidiaries, advertising/promotions agencies of Sponsor, or members of their immediate family or household.

Void where prohibited or restricted by law.

4. How to Enter

To enter, each participant must complete all required steps during the Contest Period:

Step 2: Complete the official entry form on Sponsor’s website.
Entrant must provide all requested information, including name, email address, phone number, city/state, and age confirmation.

5. Entry Requirements

Each entry must:

• be the entrant’s original work;
• truthfully reflect the entrant’s own story, views, and experience;
• comply with all applicable laws and platform rules;
• not contain false, misleading, defamatory, obscene, harassing, hateful, unlawful, or infringing content;
• not include third-party copyrighted content, music, video, logos, images, or materials unless entrant has all necessary rights and permissions;
• not feature any person other than the entrant unless entrant has obtained that person’s written permission;
• not depict dangerous, illegal, or reckless conduct.

Sponsor reserves the right to disqualify any entry it determines, in its sole discretion, violates these Terms or is inconsistent with Sponsor’s brand, values, or legal obligations.

6. Judging Criteria

This is a skill-based contest. Winner selection will be based solely on the quality of eligible submissions according to the following criteria:

1. Personal Story & Need – 30 points
   Clarity and strength of the entrant’s personal story and why winning the DX500 matters.
2. Understanding of Benefit – 25 points
   How clearly the entrant explains how Direct Current and the DX500 would benefit their training, recovery, performance, or quality of life.
3. Authenticity & Persuasiveness – 20 points
   Genuine, compelling, and credible communication.
4. Creativity & Communication – 15 points
   Originality, structure, clarity, and overall presentation.
5. Community Impact / Alignment – 10 points
   Potential positive impact on the entrant’s family, team, clients, community, or broader recovery/performance journey.

Eligible entries will be reviewed by a judging panel selected by Sponsor. The entry receiving the highest total score will be the potential winner.

In the event of a tie, the tied entry with the higher score in Personal Story & Need will prevail. If still tied, the higher score in Understanding of Benefit will prevail. If still tied, the judging panel chair will determine the winner.

All judging decisions are final and binding.

7. Prize

One (1) winner will receive:

• One (1) DX500 device

Approximate Retail Value (“ARV”): $4,995

No substitution, transfer, assignment, or cash redemption of prize is permitted, except Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.

Winner is solely responsible for any federal, state, or local taxes, fees, or other costs associated with acceptance or use of the prize.

8. Winner Notification and Verification

The potential winner will be contacted using the contact information submitted at entry.

To claim the prize, the potential winner may be required to sign and return, within the time stated by Sponsor:

• an affidavit or declaration of eligibility;
• a liability release;
• a publicity release;
• any tax forms or other documents reasonably requested by Sponsor.

If a potential winner:

• cannot be contacted;
• fails to respond within the time requested;
• is found ineligible;
• fails to provide requested documentation; or
• otherwise fails to comply with these Terms,

Sponsor may disqualify that entrant and select the next highest-scoring eligible entry.

9. Rights in Submitted Content

By entering the Contest, entrant represents and warrants that:

• the submission is original;
• entrant owns or controls all rights necessary to submit the entry and grant the rights described in these Terms; and
• the submission does not violate any third-party rights, including copyright, trademark, privacy, publicity, or contractual rights.

By submitting an entry, entrant grants Sponsor and its affiliates, licensees, successors, assigns, agencies, and designees a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable right and license to use, reproduce, host, store, copy, edit, adapt, modify, publish, display, perform, distribute, transmit, create derivative works from, and otherwise exploit the entry, in whole or in part, in any media now known or later developed, for any lawful purpose, including contest administration, publicity, advertising, promotion, marketing, education, social media, website content, email, paid media, organic media, and internal business purposes, without additional compensation, notice, or approval, except where prohibited by law.

Entrant understands and agrees that Sponsor has no obligation to use any submission.

10. Name, Image, Likeness, Voice, and Publicity Release

By entering the Contest, entrant grants Sponsor and its affiliates, licensees, successors, assigns, agencies, and designees the perpetual, worldwide, irrevocable, royalty-free right to use entrant’s name, image, likeness, voice, photograph, video appearance, social media handle, biographical information, city/state, statements, and testimonial content, as included in the submission or otherwise provided in connection with the Contest, in any media now known or later developed, for advertising, publicity, promotional, editorial, commercial, and marketing purposes, without further notice, compensation, or approval, except where prohibited by law.

Entrant waives any right to inspect or approve the finished materials or any use thereof, and releases Sponsor from any claims arising out of such use, including claims for defamation, invasion of privacy, right of publicity, or false light, except for claims arising from Sponsor’s gross negligence or willful misconduct where such waiver is prohibited by law.

11. Platform Disclaimer

If entrant submits through Instagram, entrant acknowledges and agrees that:

• the Contest is in no way sponsored, endorsed, administered by, or associated with Instagram; and
• by participating, entrant releases Instagram from any and all liability related to this Contest.

Entrants must not tag people inaccurately or otherwise violate Instagram’s terms or policies.

12. No Purchase; No Return of Entries

No purchase is necessary to enter or win.
Entries will not be returned and may be acknowledged or displayed publicly or privately at Sponsor’s discretion.

13. Sponsor’s Rights

Sponsor reserves the right, in its sole discretion, to:

• verify eligibility and submission compliance;
• disqualify any person who tampers with the entry process or violates these Terms;
• cancel, suspend, modify, or terminate the Contest if fraud, technical failures, platform issues, legal concerns, force majeure events, or other causes impair the integrity or proper operation of the Contest;
• select a winner from eligible entries received prior to cancellation, if appropriate.

14. Release and Limitation of Liability

By entering, entrant agrees to release and hold harmless Sponsor, its affiliates, subsidiaries, agencies, vendors, officers, directors, employees, contractors, representatives, successors, and assigns from and against any and all claims, demands, damages, liabilities, losses, costs, or expenses arising out of or relating to:

• participation in the Contest;
• submission or use of any entry;
• acceptance, possession, use, or misuse of the prize; or
• any technical, platform, transmission, or administrative issues connected with the Contest.

Sponsor is not responsible for lost, late, incomplete, inaccessible, corrupted, misdirected, delayed, or technically defective entries.

15. Privacy

Information collected in connection with the Contest will be used by Sponsor for Contest administration, winner selection, verification, prize fulfillment, and as otherwise described in Sponsor’s Privacy Policy and these Terms.

Marketing communications are optional and are not required to enter or win.

16. Governing Law; Disputes

This Contest and these Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of laws principles.

Any dispute arising out of or relating to the Contest shall be resolved exclusively in the state or federal courts located in Cook County, Illinois and entrant consents to the personal jurisdiction and venue of those courts, except where prohibited by law.
